EU–U.S. Privacy Shield and Swiss–U.S. Privacy Shield

OrcaBPO is in line with the EU-US Privacy Shield Framework and the US-Swiss Privacy Shield (Privacy Shield) framework. Department of Commerce on the Collection, Use and Retention of Personal Information Transferred from the European Union (EU), UK, and Switzerland to the United States in reliance on Privacy Shield. OrcaBPO has certified to the Department of Commerce that it adheres to the Privacy Shield Principles with respect to such information. In case of conflict between the terms of this Privacy Policy and the Privacy Shield Principles, the Privacy Shield Principles shall prevail. OrcaBPO is responsible for processing the personal data it receives under the Privacy Shield and then transfers it to a third party acting as an agent on its behalf. OrcaBPO complies with the Privacy Shield principles for any further transfer of personal data from the EU, the UK and Switzerland, including the onward transfer liability provisions.

With respect to personal information received or transferred in accordance with the Privacy Shield Framework, OrcaBPO is subject to the regulatory powers of the United States Federal Trade Commission. In some situations OrcaBPO may be held accountable. Under certain conditions, described in more detail on the Privacy Shield website, you may be permitted to resort to binding arbitration where other disputes are resolved.
